These are written contracts between you and your spouse that outlines your respective rights and responsibilities as agreed upon by both parties. The contract must follow the laws of the state where at least one member of the couple resides. When it is executed and recorded, it becomes a binding contract, but it does not mean you are divorced. You are legally separated, but still married. To file for divorce is a separate process and if you decide on that option, then the separation agreement is incorporated into the divorce agreement and becomes binding.


When you have agreed on all of the areas covered by the separation agreement, then you need to make sure that the forms are filled out completely and then both parties must sign it in front of a witness and a notary public. You can easily do this at your bank where they also have a notary on staff and plenty of witnesses as well. Most banks will provide this service for no cost to their customers. After all the papers have been signed, witnessed and notarized, it is recommended that you take them to the county court house and file them so they become a part of the public record.
